IRA Non Recourse Investment Loans
IRS rules stipulate that any retirement account that obtains financing as part the purchase process must takes out specific kind of loan. This loan is called a Non Recourse Loan and is designed to limit the liability of the borrower to only the retirement account itself with no individual guarantee from the account holder.
In fact, in cases where a personally guarantee loan is used to purchase property held within a retirement account, the IRS deems a prohibitive transaction. The effect of this is the entire balance of the retirement account is subject to withdrawal, taxation, interest and penalty fees.
